Business' Initial Response

Dominick's complaint as to Coastal Breeze Properties giving him false/misleading information as to the association approval time frame is false. Dominick had a Real Estate Agent representing him and we communicated through her not directly with Dominick. We advised her that the association could take up to 30 days to approve an application. We did not have direct communication with Dominick until later in the transaction when he called upset that his application had not been approved yet at which time we told him the same thing we told his agent. That it could take up to 30 days for the application process. If he was given misinformation it was by his agent not by us. The time frame is also clearly stated on the application package. This statement is totally false.

Regarding the puddles on the floor. Dominick did complain about the puddles on the floor which according to him and his wife would appear through-out the house both upstairs and downstairs in different places. We sent our handyman out who did a leak detection both upstairs and downstairs and found no leaks. He suggested it could be the dog peeing on the floor.We then sent the builder out. He also confirmed there were no leaks and suggested it could be the dog peeing on the floor. When the tenant moved out I visited the property on a daily basis looking for the mystery leaks and there were never any found over the course of 3 weeks. We now have a new tenant there for 2 months and have had no complaints of leaks or puddles on the floor. The carpet cleaning that we charged to the tenant is justified. In fact, I should have also charged them for the leak detection as the "leaks" were being caused by the tenant and not a defect in the property.

Our first experience with Coastal Breeze Properties involved a lie. We had 6 days to find a place to live due to unforeseen circumstances. Kiki indicated it would be no problem to get us into her unit in Monterey in that time, as the HOA would approve us in a few days. This was untrue, as the HOA representative stated it takes 2 weeks or longer and “Kiki knows this”; it ended up taking 2.5 weeks, during which time my wife and I had to stay with my mother and aunt in their 2 bedroom unit. Kiki denied ever telling us we could move into her unit in 6 days. Our next problem with Coastal Breeze came several months later when strange water leaks began occurring in our unit. I witnessed water bubbling up from the grout downstairs and there were several leaks coming from underneath the carpet upstairs. Coastal Breeze did little to rectify the situation. They sent their maintenance man but the problem was out of the scope of his expertise; he actually blamed the leaks on our dogs, which was clearly not the case considering that the water was not urine, came from underneath the flooring, and was much greater in volume than any dog could produce. Coastal Breeze then sent the builder, who could not figure out the problem; he was supposed to return again but was a no show. After this, we continued to document and take pictures of every leak, which we emailed to Kiki. Weeks went by with no response and no action on her part. She should have had a plumber or other professional out to assess the problem, as it presented safety issues; both my wife at 7 months pregnant and my mother slipped in the water and nearly fell. Our final complaint is regarding the $170 deduction Kiki took from our security deposit for a “move out carpet cleaning”. She had no right to charge for this as our lease did not stipulate our responsibility for such. Our lease did state “TENANT shall peacefully surrender the premises…leaving the premises in good, clean condition, ordinary wear and tear excepted”. We left the premises in immaculate condition and took photos and videos to document this. There were neither stains nor physical damage to the carpet caused by us that could possibly be considered beyond normal wear and tear. In fact, the main reason Coastal Breeze needed to clean the carpets was due to the leaks that were their responsibility to fix. We sent a certified letter contesting Kiki’s deduction from our deposit and called and emailed several times but received no response.
