PROCEDURES:
A contract is executed between the court (judge), bail bonds agent and the co-signer. The co-signer is anyone who may be in charge of posting the bail for the defendant, or the defendant, in some cases, can be the co-signer. The bondsman/co-signers will be the responsible parties, assuring the court of the defendant's obligatory appearances. The court, according to the criminal nature of the arrest, will decide upon a designated bail amount.
Sometimes due to the severe nature of the crime, the judge may not allow for a bail in particular cases. A bond is a form of money in collateral. Collateral can be houses, vehicles, cash, jewelry, boats and more - call to ask. Bonds act like a reminder to the defendant to show up for all obligatory appointments, as needed. This is a contract telling the judge, in essence, that one will not flee to become a fugitive and forfeit the collateral (money). There is a fee for the transaction of a bail contract, which varies across the United States. The fee for New Jersey will be ten percent of the total bond.
The bondsman must assure the judge that the defendant will attend all appointments, and there will be a schedule of "Check-ins" between the agent/accused (Defendant). If the accused decides to flee (become a fugitive), and cannot be found by the agent or the co-signer, the total amount of bail is in forfeiture, (Full Amount Due). Forfeiture means the co-signer loses the collateral totally. When the fugitive is found and apprehended, the co-signer will also need to pay the agents' overhead expenses for the searching.
Defendants can choose between the services of a bail bond agent or paying the full amount directly to the court. The differences are:
* Paying directly to the court - Full amount due.
* Services of Bondsman - Just ten percent required, plus collateral in contract to secure all appearances.
* When all obligatory appointments are fulfilled and the case closed, the bond will be canceled. This means that the collateral will be restored to the co-signers name. This important information will be written into the contract.
