Dear Mr. Hogate, The 2012 Ford F-250 you purchased from Cartersville Trucks was purchased in “AS IS” condition and per the Georgia “Lemon Law” clearly stating all used vehicles sold in Georgia are sold in “AS IS” condition. it has come to our attention that you have issued a formal complaint against Cartersville Trucks with the BBB. More importantly, Cartersville Trucks has also learned that you have posted defamatory and slanderous accusations on several public social media sites (Google Reviews and Yelp) describing Cartersville Trucks’ inventory as being “Damaged due to flooding in Texas.” Please carefully note the following: 1. Cartersville Trucks unequivocally denies the defamatory and slanderous accusations you have posted stating that “My truck is not the only truck that came from Texas after the flooding that occurred and he has multiple trucks on his lot that had these SAME ISSUES.” 2. The statement(s) you posted to Google and Yelp reviews are completely false. 3. Cartersville Trucks has never authorized an inspection by you or your wife of any vehicle in our inventory other than the 2012 Ford F-250 and the 2006 Dodge 2500; which were the only vehicles in Cartersville Trucks inventory you test drove in making your purchase of the 2012 Ford F-250. 4. You nor your wife possess any first-hand knowledge of Cartersville Trucks’ inventory of vehicles other than the 2012 Ford F-250 and the 2006 Dodge 2500; which were the only vehicles in Cartersville Trucks inventory you had access to and test drove in making your purchase of the 2012 Ford F-250. 5. You nor your wife have the ability to substantiate the defamatory and slanderous accusations regarding any vehicles in the Cartersville Trucks inventory other than the 2012 Ford F-250 in question and the 2006 Dodge 2500; which were the only vehicles in Cartersville Trucks inventory you test drove in making your purchase of the 2012 Ford F-250. To this point, Cartersville Trucks followed all company guidelines and policies regarding your acquisition of the 2012 Ford F-250 in question as well as the pre-sale inspection and test drive. Additionally, Cartersville Trucks also adhered to the dealership’s policy as well as the Georgia Lemon Law regarding the sale of used vehicles in an “AS IS” condition making you fully aware of the “AS IS” nature of the sale prior to the purchase being complete, during the negations for the purchase, and at the time the sale was made final. To this point, the only action(s) Cartersville Trucks has made which was not in accordance with our operational practices and guidelines and contrary to the Georgia Lemon Law, was when Cartersville Trucks issued the buyer a check for $1,500 in our efforts to assist the buyer in mitigating the unforeseen repair expenses. A check which you have since deposited and cashed to your personal benefit. For these reasons as well as the fact that Cartersville Trucks has made considerable efforts to resolve this matter in your favor, Cartersville Trucks is formally requesting that you issue an immediate retraction and removal of all false, defamatory, and slanderous accusations from Google Review and all other public review sites which they might have submitted their reviews. It is the position of Cartersville Trucks that you and/or your wife posted defamatory and slanderous accusations on several public social media sites with the sole intent of harming the reputation and business dealings of our dealership. These actions are illegal and actionable. Your failure to immediately issue a retraction and remove all false, defamatory, and slanderous accusations regarding Cartersville Trucks places the dealership in the position of considering future legal actions.
