AVALON NIGHTMARE

On jan 16 th at aproximately 10 am , Sprinkler system above our

second floor 3 bedroom apartment burst. Three floors in a row were

flooded and totaled. Ceilings were taken down , walls and floors. The

sprinkler PIPE that burst was not properly insulated or heated,

causing it to burst sending a waterfall from the third floor down to

the garage. All tenants had to evacuated from the three floors . The

company says it is not responsible for any damages. ALL my things

without exception were damaged. My renters insurance is not enough to

cover it. The company claims their lease clearly states that they are

not responsible for damages to renters property in Matters of flood.

BUT this is not a matter of 'flood' but a matter of gross negligence

- be it engineering fault or the fault of the management company to

properly heat the PIPES containing wet water sprinkler systems. LOSS:

aside from the total damage suffered we were put into a one bedroom

smaller apartment " for the time being" which we have to pay for now.

We have 2 more people moving with us in 5-10 days , a small child and

an elderly lady who we have NO WHERE to put. We lost 3 days of work

moving in and out, and so far we have heard nothing from the

management company and the owners about any kind of compensation

coming from their end. Renters insurance IS not supposed to be the one

covering loss due to gross negligence and total mismanagement that

caused this disaster. Moreover the apartment they moved us into had a

small leak the very next day from what they called a faulty gutter

above us. The only offer coming from the Avalon management is for us

to either move out or move back into the apt we had rented from them

after it gets fixed. No one knows when it will be fixed since the

problem was so overwhelmingly huge.And even if they do fix it , the mold will be present for a very long time. Question arises as to how

something of this magnitude could happen and why the management does

nothing to take care of this. Who is responsible'??'' Inspectors??' Engineers'??? And why is it my problem for the amount of MONEY I AM PAYING FOR THIS NIGHTMARE.
