My boyfriend purchased a truck from West Oaks Auto Plaza with an agreement of a 25,000.00 down payment that would be paid in 3 payments. He paid 2 payments towards the down payment and had a health issue arise in which would cause the 3rd payment to be delayed. As soon as he was able to call and let Dave Ward, the owner of West Oaks Auto Plaza know 3rd payment funds would not be available on date due he did. The truck was picked up the day after payment did not clear the bank. The first payment on the truck was not even due yet and Mr Ward received more than half of down payment. Repeated calls were made to speak with Mr Ward, the owner of West Oaks Auto Plaza who the 25,000.00 down payment in 3 payments agreement was made. Mr Ward has refused all calls as well as chose to not return calls as requested. A copy of the signed contract has been asked for on two separate occasions. The first time he was told it could not be located. The second time he was told to leave an address and Mr Ward's attorney would send it. He left his current home address and has yet to receive a signed contract with signature or a letter from Mr Wards attorney. So it seems in West Oaks Auto Plaza's business practices it is ok to take around 18,000.00 dollars from someone, pickup the truck one day after funds weren't available for the 3rd payment towards the 25,000.00 down payment after receiving well over half of it, refuse to accept calls, not return calls, keep the money given towards the down payment, put the truck back on the lot for sale and deny a copy of the signed contract to the buyer.

After exhausting all avenues to work this matter out civilly and as adults there is no other choice or option but to have counsel represent the buyer. Complaints have also been filed with the Houston BBB, The Texas Department of Motor Vehicles, Federal Trade Commission, as well as posting numerous reviews so that other consumers may be aware of the deceptive business practices of West Oaks Auto Plaza and owner Dave Ward.

buyer beware

these guys just stole my car at one in the morning and they send drug dealer types to do it. my monthly payment start next month and some kind of way they claim I'm two payments behind. just like with the other person they claim to not have proof of this and that. I should have known better when at the office donny told me the 10,000 mile difference on the papers and the actual car didn't matter. I think that may be a federal crime so I'll be looking all into that. another thing is the payment schedule. they tell you they only finance for two years (I have an actual recording of the "woman" saying it) and then the payment seem to go for nearly 4 years. I have every interaction with them saved on my SD card so court here we come. oh and they send you to a place down the street to get inspection from some propane place and they just give you a sticker without hooking up the car so that's one more thing to investigate.

Beware of West Oaks Auto Plaza...

Beware of West Oaks Auto Plaza. I purchased a vehicle from them in December 2010. Aside from their unprofessional staff and over priced vehicles, they have zero business ethics. After accepting my $4,500 down payment for a $17,000 car, they suddenly were unable to receive timely payments and began wanting to seize the vehicle. I provided proof of the money orders that were submitted but they started asking me to come to their office. Which was strange so I Googled their company and realize this was a tactic for them to take the vehicle back. For lack of a better word, the woman that began calling me was shady. I believe she was the owners wife and continued tio play devils advocate. She said I paid too much. The owner was ripping me off and she was going to mediate if I would just return the vehicle. She said he could possibly return some of the down payment. Really? I did pay too much and was on board BUT I wanted something in writing. I read other reviews where they lure previous clients back and guess what? No vehicle! How can companies operate this way? I later received my payments back from Wells Fargo. The payments I sent via bill pay were never cashed! I'm sure they operate by re-selling the same vehicles and taking the down payments from unsuspecting folks like myself. I was hoping they would realize their errors and want to work with me, never happened. One day my husband went outside and the car was gone. They never returned any of the items in the car either. I think they peeled the inspection and registration stickers so I couldn't drive it, I can't prove it but it's very suspicious. My husband was the last to drive it and he left a box of extremely personal and priceless items in it. I filled out an online pollice report but nothing ever came of it. They never sent the plates so we couldn't even drive the vehicle. I should have known better than to purchase there. There were red flags; used car salesman ambiance, unclear answers about the terms of the contract, suspicious owner... but at the time I needed something ASAP and went alone. Which I wouldn't recommend. I'd like to hear from others. I was trying to begin a lawsuit but my attorney friend completely dropped the ball. Any others in the same boat?
