The mediator in my situation was not impartial. Every time he entered the room where I was with my attorney he would announce how impartial he was and the more he said it the more partial I knew he was.
He was rude and disrespectful. He spent 90 percent of his time with the defendant. Every time he was with the plaintiff (me) he would nor listen and seemed hostile. What did it for me was when he looked at the photos of the property loss concerning the vehicle involved and being it was a total loss in a major impact collision he said to me” The property loss is major”. It’s too bad your injuries don’t stand up to the property loss”. “ You must have been in really good health when it happened”. Who says crap like that in a professional setting in a lawsuit that is very serious to me as I have suffered the demise of my health as I knew it prior to the automobile accident that was a high speed 10 car pile up on the interstate where I had no fault whatsoever except for being at the wrong place at the wrong time. Also, “it’s too bad you didn’t break something”. Really, I’m in pain every day. It ruined my business as I was self employed, lived alone and had to cover all my home expenses and office expenses. My job is physical as a therapist and I could not carry on. This person clearly was in the defendants pocket, so obvious it was sickening and my attorney was right there with him. What a ruse!
