Provided by YP.comI was told when I listed my house through and agent that I could cancel my contract at any time if I was to become unsatisfied. I decided to cancel my contract with my agent. Trust me,,,,,,,,, cancelling it isnt as simple as the make it to be....... Or they lead you to believe. Don't be a sucker.
Here is their loophole.
Just cause you cancel your contract with your agent, doesnt mean that you cancel it with the Broker (CUMBERLAND REAL ESTATE) You can cancel it with your agent of course. HOWEVER they are only the agent not the broker.. You are still bound to Cumberland ( THE BROKER) Until You sell or your contract EXPIRES. Our contract was written for 4 Months,,,,,,,,,,,,, then 30 days after that ( In your contract, they tie you over for 30 days AFTER THE EXPIRATION DATE! . That makes ANY SALE ON YOUR PROPERTY being tied to CUMBERLAND REAL ESTATE for 5 MONTHS or HOWEVER LONG THEY WRITE YOUR CONTRACT FOR!
The only way that you are "CANCELLED" from them is to have the MANAGING BROKER RELEASE YOUR LISTING PRIOR TO YOUR EXPIRATION DATE!!! Trust me, they are not so willing to do that.
I WAS NOTIFIED OF THIS BY A REAL ESTATE LAWYER WHO REVIEWED MY LISTING AGREEMENT!
N PARAGRAPH 3 OF THE CUMBERLAND EXCLUSIVE LISTING AGREEMENT, IT STATES,
SHOULD THE SELLER CONTRACT TO SELL EXCHANGE OR CONTRACT TO LEASE OPTION TO BUY THE PROPERTY WITHIN 30 DAYS AFTER THE EXPIRATION OF THIS AGREEMENT TO ANY BUYER (OR ANYONE ACTING ON THE BUYERS BEHALF) WHO HAS BEEN INTRODUCED TO THE PROPERTY DIRECTLY, OR INDIRECTLY DURING THE TERM HEREOF SHALL CONTINUE UNTIL FINAL DISPOSITION OF PURCHASE AND SALES AGREEMENT. SELLER AGREES TO PAY ALL COSTS INCURRED TO MARKET THIS PROPERTY AS A CANCELLATION FEE SHOULD BROKER CONSENT TO RELEASE LISTING PRIOR TO EXPIRATION DATE.
In everyday terms, that means, if you sell, or even lease option buy your own home, TO ANYONE within 30 days AFTER the expiration Date, It doesnt matter if they showed the property, or you took the time to do it and answer all of the calls. Then the contract continues until the end of the sale. (at that point they still get their 6,000 per every 100,000) It plainly states that IF BROKER (CUMBERLAND REAL ESTATE....) Notice it mentions NOTHING ABOUT your agent......... consents to release you from your listing, you agree to pay all marketing fees.... (MLS Lisings, Sign rental, Gas for trips to and from your house, to show it, or to deliver you papers, any printing fees, lock box rental.....etc).
That is basically what you pay for trying to end your contract with them and regain your rights as a property owner to sell your own house if you are unhappy with them...........................................From personal experience,and many people I know in the Lebanon area.
Should you choose to sign with them.....MAKE SURE THAT YOUR CONTRACT EXPIRES IN 30 OR LESS DAYS AND THEN RENEW IT EVERY 30 IF YOU ARE SATISFIED.
