My husband and I have mask exemptions. As per the law, and stated in the Santa Clara County "orders", if you have a medical issue that keeps you from wearing a mask, you do not have to. The ADA does not allow discrimination based on a disability. My husband went to shop at See’s. Upon entering the store, he started to shop. There were no employees at the counter. He grabbed some items and the employees came from the back room. They asked if he had a mask. He told them he had an exemption. They told him there are no exemptions. He asked if they had read the law. They said that no exemptions were allowed. They offered to talk to him outside. The clerk took him outside but refused to talk to him. As she was going back into the store, he said he wanted to get a quick statement on video that she was denying him service even though he had an exemption and she said that would not be necessary. He started recording on his phone and went back into the store to get a statement. The two clerks started yelling, as did two customers. The clerks screamed at him to leave and refused to tell him their names. I called the store and asked for the name of the clerk. They would not give it but gave a number for a manager. I called the manager who said the same things but said that he should have been offered the option of shopping online and picking up or shopping outside the store. Neither was offered. I tried to explain the law to the manager but she said she would forward this to another manager and hung up on me. We received calls from two more managers who both refused to budge on their "policy". I was offered a $50 gift card for the trouble but this feels like a slap in the face. You can choose to believe that the store did the right thing and exemptions are not allowed. I would encourage you to look at the "orders" for yourself and also so some research.
