There are two basic areas of Bankruptcy that benefit consumers, homeowners and small businesses. 1. Chapter 7 benefits families and individuals who are overwhelmed with debt, whether it be from consumer debt, health catastrophe, loss of income, business failure, or other reasons. The debts are wiped out and the person or family gets a fresh start. In most situations, the person or family is able to keep their family residence, automobiles, furniture and personal affects, even though their debts are discharged. 2. Chapter 13 benefits individuals and families who are in danger of losing their home to foreclosure, and, in certain instances, individuals and families who, for one reason, or the other, intend to pay all or part of their debt, but wish to consolidate them into one single smaller payment. Chapter 13 stops foreclosure proceedings against the family residence and provides a payment plan for the homeowner to catch up. 3. Small business owners, on occasion, find it necessary to liquidate and go out of business. Chapter 7 proceeds permit the business owner to discharge the debts arising from the failure of the business. This can be done whether the business is a proprietorship, partnership or corporation. Sometimes, a proprietorship (not a partnership or corporation) can be salvaged and kept in business by the filing of a Chapter 13 Debt Consolidation.
