Our home is unfortunately next to a home construction project conducted by Mattern and Fitzgerald. The construction has gone way over the original timetable and is now going on one year. The home site construction is on a slope uphill of our property. The first problem began when the site clearing began, and huge boulders rolled down and knocked down part of our fence. Our fence actually stopped some of these massive boulders from rolling further into our yard. My wife and grandson would not walk in that part of the yard for months for fear from more boulders and debris rolling down into our fence/yard. Also we had to limit access to our dog from going outdoors because of the busted fence. For almost the first half of the construction project., Mattern and Fitzgerald did not install the required sediment barriers around the construction site. The barriers were only erected after I said something.

A new problem occurred after some rain showers. Soil and gravel eroded off of their construction site and washed into our yard traveling as far as 150 feet during one rainstorm. The wash-out and debris also washed-out the crushed granite that we had on a trail long the fence. We asked the builders to provide new crushed granite to replace our loss, but they denied any responsibility. They increased the slope/gradient, tore-off all the vegetation, did not erect the required sediment barriers, and then they claimed that they actually reduced erosion by building a house up-hill!

Also, I had to pick-up trash that was thrown-in and blown-into my yard by their workers. Some of the debris was stuffed under bushes by my fence.

As an aside, I understand that there were significant cost over-runs and issues with the new house.

The builders did eventually fix my fence almost a year after construction started, but they continue to deny any responsibility for the erosion and crushed granite.

I have photos and correspondences documenting the damage, and builder responses.



I believe you can learn about companies how they treat people in small things – the same attitude and ethics tend to carry forward on the big things.



If you do decide to work with Mattern and Fitzgerald, I think it would be a good idea to have you own lawyer look things over before you sign anything.
